I am serving you this legal notice on behalf of Chittagong Port Authority (CPA) and the Chairman, Chittagong Port Authority (CPA). Chittagong Port Authority (CPA) is a Government organization entrusted with running the largest sea port of Bangladesh.Two identical news reports had come to our attention published in the newspapers/ online portals of the notice receivers on 06.09.2025. Chittagong Port Authority (CPA) is shocked by this news and being aggrieved by the news published by you in your newspapers/ online portals we are serving you the below legal notice.
1. That on 06.09.2025 identical news was published in both the notice receivers' newspapers with heading " চট্টগ্রাম বন্দর ডিজেল সিন্ডিকেট চেয়ারম্যানের একক সিদ্ধান্তে মাফিয়া চক্রের উত্থান: The Chittagong port authority has gone through the news and is hereby protesting about the news. The news claims and falsely alleges the involvement of Chairman, Chittagong Port authority (CPA) in the solicitation of a supply contract for
the Matarbari Port Development Project Package-1 (Civil Works). Your newspaper/online news portal also published that the Chairman, Chittagong Port Authority is in constant contact with a person who allegedly lives in Singapore and the port Chairman is assisting that person and his company in procuring a contract for supply of diesel to the contractor of Matarbari Port Project. A picture of the Chairman, Chittagong Port authority was also published with the news article. These defamatory and baseless assertions are categorically rejected by the Chittagong Port Authority and its Chairman. The news article is completely false and absurd as the purported supply of diesel is procured by Pentaocean-Toa JV which is the contractor for Matarbari Port Development project which is funded by JICA and any procurements made in that project are subject to rigorous adherence of guidelines set forth by JICA as well as procurement regulation of the Bangladesh Government.
2.The Chittagong Port Authority has the mandate to run and manage port operations of Chittagong Port as per the Chittagong Port Authority Act 2022. That under the leadership of the current Chairman the Chittagong port authority is performing very well. As per Section 51 of the Chittagong Port Authority Act the Chairman of Chittagong Port is a 'Jonoshebok'. The Chairman Chittagong Port Authority Rear Admiral S M Moniruzzaman OSP, NDC, NCC, PSC is a man of great reputation and glorious naval career and as such publishing baseless, false, defamatory news both in print and online version of your news outlets amounts to defamation as per the definition of defamation in Penal Code of Bangladesh contained in Section 499 of Bangladesh Penal Code 1860. Therefore we demand upon you to withdraw the news from your website, social media pages and publish a news seeking apology within 2 days of receiving this notice otherwise we have clear instruction from our client to institute a suit for defamation
claiming compensation of 500 Crores Taka and criminal case under Section 500 of the Penal Code 1860.
